DUI Penalties

Driving under the influence is one of the most commonly committed crimes in the country. It not only puts the driver’s life in jeopardy, but it also risks the lives of innocent passengers and drivers on the road. For this reason judges, prosecutors, and law enforcement officials are devoted to punishing DUI offenders and seeking the harshest penalties necessary.

Certain variables will increase the severity of the penalties, such as prior DUI convictions, the presence of minors in the car, if the driver refused a BAC test, or if the driver caused an accident that resulted in injury or death.

In Georgia, DUI offenders are subject to the following legal penalties:

1st DUI Conviction:

  • Jail time: 10 days to one year
  • Probation
  • Fines: $300 to $1,000
  • Driver’s License Suspension: up to one year
  • Other Penalties: community service, DUI school, increased insurance costs, reinstatement fees

 2nd DUI Conviction:

  • Jail time: 90 days to one year
  • Probation
  • Fines: $600 to $1,000
  • Driver’s License Suspension: up to three years
  • Other Penalties: community service, DUI school, alcohol treatment program, ignition interlock device, increased insurance costs, reinstatement fees,

3rd DUI Conviction:

  • Jail time: 120 days to one year
  • Probation
  • Fines: $1,000 to $5,000
  • Driver’s License Suspension: up to five years
  • Other Penalties: community service, DUI school, alcohol treatment program, ignition interlock device, increased insurance costs, reinstatement fees

4th DUI Conviction:

  • Jail time: one to five years
  • Probation
  • Fines: Up to $5,000
  • Driver’s License Suspension: up to five years
  • Other Penalties: community service, DUI school, alcohol treatment program, ignition interlock device, increased insurance costs, reinstatement fees; vehicle may be confiscated

Other DUI Penalties:
In addition to these penalties, DUI offenders will also be included in the National Driver’s License Registry and receive a mark on their permanent criminal record. DUI offenders also face damage to their personal and professional reputations. People convicted of a DUI may lose their job, have trouble finding employment, and suffer from a tarnished reputation, debt, limited opportunities, and strained relationships.
