DMV Hearings
If you are suspected of drunk driving and refuse to take a chemical test (breath, blood, or urine test), or if you took a chemical test and the results indicate that your BAC is at or above .08%, then you will be arrested for DUI. At this time your driver’s license will automatically be confiscated and suspended. You then have 10 days from the date of your arrest to schedule an administrative hearing with the Georgia Department of Motor Vehicles to challenge the suspension. If you do not schedule a hearing within 10 days, you will lose your right to a hearing in the future, and your license will be automatically suspended for one year.
